These Terms of Use ("Terms") govern your access to and use of the prepare4sale.com.au website and related services ("the Platform"), operated by Prepare 4 Sale ("we", "us", "our", ABN 15 677 761 787). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. About the Platform
Prepare 4 Sale operates a directory connecting Australian home sellers with local service providers, including (but not limited to) real estate agents, property stylists, photographers, trades, building inspectors, and conveyancers. The Platform is free to use for home sellers. Service providers may apply for paid or free listings under separate provider terms.
We are a directory and information service. We are not a real estate agency, broker, or party to any transaction between sellers and service providers.
2. Eligibility
You must be at least 18 years of age and capable of forming a legally binding contract under Australian law to use the Platform. By using the Platform you represent that you meet these requirements.
3. Acceptable use
You agree to use the Platform only for lawful purposes. You must not:
- Use the Platform to harass, defame, threaten, or harm any person.
- Submit false, misleading, or fraudulent information through any form on the Platform.
- Submit reviews you do not have direct experience to support, or solicit fake reviews.
- Attempt to access non-public areas of the Platform, interfere with security features, or disrupt the service.
- Use automated tools to scrape, harvest, or collect information from the Platform without our written consent.
- Use the Platform to distribute spam, malware, or unsolicited commercial communications.
- Reverse engineer, decompile, or disassemble any aspect of the Platform.
4. Listings and provider information
Service provider listings are submitted by the providers themselves. While we verify business registration and category fit before approving listings, we do not independently verify the quality, safety, qualifications, licensing, insurance, or performance of any listed provider.
You are responsible for performing your own due diligence before engaging any service provider you find through the Platform — including confirming licensing, insurance, references, and contractual terms directly with the provider. Any agreement, transaction, or dispute is solely between you and the provider.
5. Reviews
Reviews submitted to the Platform must be honest, based on your own genuine experience with the provider, and not contain unlawful, defamatory, or abusive content. We reserve the right to remove any review that breaches these guidelines or our review policy.
By submitting a review, you grant us a non-exclusive, royalty-free, perpetual licence to publish, display, reproduce, and use the review on the Platform and in our marketing materials. Reviews remain your statements; we don't endorse or adopt them.
6. Forms and data submission
When you submit any form on the Platform (contact, provider enquiry, etc.), you confirm the information provided is accurate and that you consent to be contacted by us — and, where applicable, by the relevant service provider — regarding your submission. Personal information is handled in accordance with our Privacy Policy.
7. Intellectual property
The Platform and its content (excluding user-submitted content and provider listings) — including text, graphics, logos, icons, images, and software — are owned by or licensed to Prepare 4 Sale and protected by Australian and international intellectual property laws. You may view and use the Platform for personal, non-commercial purposes; you may not copy, reproduce, distribute, modify, or create derivative works without our written permission.
8. Disclaimer of warranties
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, regarding:
- The accuracy, completeness, or currency of any content on the Platform.
- The quality, safety, or suitability of any provider listed on the Platform.
- The Platform being uninterrupted, secure, or error-free.
- The results obtained from using the Platform.
Nothing in these Terms excludes any rights or remedies you may have under the Australian Consumer Law that cannot be excluded.
9. Limitation of liability
To the maximum extent permitted by law, Prepare 4 Sale will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, or data, arising from your use of the Platform — even if we have been advised of the possibility of such damages.
Where our liability cannot be excluded but can be limited, our total aggregate liability to you arising from or in connection with the Platform is limited (at our option) to: re-supplying the relevant service, or paying the cost of having the relevant service re-supplied.
10. Indemnity
You agree to indemnify and hold Prepare 4 Sale harmless from any claim, loss, liability, damage, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or your interaction with any service provider listed on the Platform.
11. Termination
We may suspend or terminate your access to the Platform at any time, without notice, if we reasonably consider you have breached these Terms or are using the Platform in a manner that is harmful to us, other users, or the integrity of the Platform.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
13. Governing law
These Terms are governed by the laws of South Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of South Australia in respect of any dispute arising from or in connection with these Terms or the Platform.
